Scope
These General Terms and Conditions (GTC) govern all legal relationships between the company Pro Pickleball (hereinafter "Seller") and its customers (hereinafter "Buyer") in the context of contracts concluded via the online store (pro-pickleball.ch). Any deviating terms and conditions of the Buyer shall expressly not apply.
Contractor
The contracts are concluded with Pro Pickleball GmbH, located at Firststrasse 15, 8835 Feusisberg, Switzerland. The seller can be reached via the contact form or by e-mail (info@pro-pickleball.ch). Orders, inquiries, complaints and any other notifications are to be sent to these contact details.
Offer and Delivery
The offers presented on the pro-pickleball.ch website are non-binding. The product information is for illustrative purposes only and is not binding. We reserve the right to change prices and product ranges and to make technical adjustments. The offers are valid as long as they are visible on the website and while stocks last.
By submitting an order in the online store and simultaneously agreeing to these GTC, the buyer makes a binding offer to conclude a contract. The contract is concluded as soon as the buyer receives an order confirmation from the seller by e-mail. In the online store, the delivery method and the delivery costs are displayed.
Information on availability and delivery times are not binding. If an item is not in stock, the buyer will be informed as soon as possible when the delivery can be expected. The seller is not liable for delivery delays caused by manufacturers or third parties. All information on delivery times is therefore without guarantee and may be changed at any time. Delivery is at the expense and risk of the buyer.
Pricing and payment
Prices are quoted in Swiss francs (CHF). Published prices and conditions are subject to change without notice.
Payment for the ordered goods is made in advance and can be made by TWINT, credit card, Apple Pay, Google Pay or other payment methods. The seller reserves the right to exclude individual payment methods without giving reasons.
The delivered goods shall remain the property of the Seller until payment has been made in full. The seller is entitled to make a corresponding entry in the retention of title register. In the event of default of payment by the Buyer, the Seller may, among other things, withdraw from the contract and reclaim the goods.
Warranty and liability
Defects or incomplete or incorrect deliveries must be reported to the Seller in writing without delay, but no later than 14 days after the date of delivery. Hidden defects must be reported in writing without delay, but no later than 14 days after discovery. Claims of the buyer expire if the notification is not made in time. In the case of a defect-free product, the buyer will receive a replacement delivery after returning the product. If no replacement delivery is possible, the seller will refund the amount paid. Further claims, in particular for reduction, withdrawal or compensation for consequential damages, if legally permissible, are excluded.
Claims for defects shall be forfeited in the event of improper use of the goods by the purchaser. Normal wear and tear, improper handling or damage by the buyer or third parties as well as defects caused by external circumstances (improper storage, frost, heat, humidity, improper storage, etc.) do not entitle the buyer to withdraw from the contract or to replace the goods. The seller assumes no liability for such defects. The return of goods is at the expense and risk of the buyer. The products must be adequately packed in the original packaging. If the Seller cannot determine any defects covered by the warranty or covered by the manufacturer's warranty, it may charge the Buyer for the costs of inspection and shipment of the goods.
Other claims of the Buyer, irrespective of the legal grounds, are excluded to the extent permitted by law. The Vendor, its agents and any vicarious agents shall not be liable for any damage that has not occurred to the product itself, in particular not for consequential damage, loss of profit or other financial losses of the Buyer. Any liability of the Seller in connection with the offer (in particular incorrect illustrations, texts and prices) and the delivery is excluded to the extent permitted by law.
Cancellation, return and right of withdrawal of the buyer
Orders of the buyer are binding and the customer is obliged to accept the delivery. Subsequent changes at the request of the customer are possible at the discretion of the seller. The buyer has the right to return the goods within 14 days of receipt and revoke the contract. The right of withdrawal can be exercised only if the goods are returned unused, undamaged, complete and in the original packaging. Upon receipt of the returned goods in the described condition, the seller will refund the value of the goods. The goods must be returned at the expense, risk and responsibility of the buyer.
Copyrights
All texts, images, graphics, video and animation files are subject to copyright and other laws protecting intellectual property. They may not be copied or changed or used on other websites without the consent of the seller.
Privacy Policy
Data protection is carried out in accordance with the seller's current privacy policy, which is available at pro-pickleball.ch.
The Seller may send the Customer information about other products or services of the Seller (e.g. in the form of a newsletter or by mail). If the Customer no longer wishes to receive such communications, the Customer may unsubscribe at any time by emailing info@pro-pickleball.ch.
Applicable Law and Jurisdiction
The Seller reserves the express right to amend these GTC at any time and to apply them immediately.
If any provision of these Terms and Conditions is found to be unlawful, void or unenforceable, such provision shall remain enforceable to the fullest extent permitted by law. The unenforceable portion shall be deemed severable from these Terms and Conditions, and such determination shall not affect the validity and enforceability of any remaining provisions. All contracts with Seller shall be governed by Swiss law, excluding the substantive rules of conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods (CISG). In the case of orders placed by private individuals for private use, the place of jurisdiction shall be in accordance with the consumer protection provisions. In all other cases, Zurich shall be the exclusive place of jurisdiction.
